 PRELIMINARY TERMS FOR THE SMITH LAND AUCTION

1>     All bidding is open to the public. In order to bid, you need only to have your bid be recognized by the auctioneer. Bidders may bid on individual tracts, any combination of tracts or on the land in its entirety.

 

2>     All bids shall remain irrevocable for a period of 30 minutes after the close of the auction.

 

3>     Increments of bidding shall be at the discretion of the Auctioneer. Tie bids and or any other disputes shall be settled by a decision from the Auctioneer. Decisions of the Auctioneer are final.

 

4>     If you are the high bidder and your bid is accepted, you must deposit 10% of your bid (PERSONAL CHECKS ARE OK) and sign a purchase agreement today. This sale is not subject to financing. We are assuming that all financing arrangements have been made or are in process and you will be in a position to pay cash for the property at the closing. The earnest money deposit is non-refundable.

 

5>         Closing will be in 30 days or on or about January 10, 2005. A Title & Escrow firm will handle closing arrangements. Seller will provide a Warranty and Title insurance. Any closing fee will be divided between buyer and seller. If a new survey is required for any reason, the buyer(s) on a per tract basis shall pay the cost of such survey.

 

6>         The seller is not providing any warranties or guarantees of any type expressed or implied with regard to the condition of the buildings, land, soil or water. This property is being sold unconditionally AS-IS. Your complete inspection of the property is invited and recommended. Parcels are legal with regard to size and shape per Elkhart County Zoning Ordinances except # 10 & 11. However no guarantee is made with regard to the issuance of any building or septic permits.

 

7>         Deed restrictions will be recorded for Tracts 12-20 prohibiting the mobile or steel chassis double wide homes.

 

8>     Possession of the property will be granted on the day of closing. The Seller will reserve the right of possession of the Quonset Building. Details will be announced on Auction Day.

 

9>         Real Estate taxes will be prorated as of the day of the closing.
